New York's Statute of Limitations For Medical Malpractice
In New York, medical malpractice claims must be filed within 2.5 years from the date the negligent action or inaction that caused the injury occurred. However, there are five exceptions to this rule:
Failure to Diagnose or Misdiagnosis of Cancer
You have two years to file a claim after learning about the failure to diagnose or misdiagnosis of cancer.
Foreign Objects Left in the Body
You have one year to file a claim after the discovery of a foreign object or facts that would cause a person to discover the problem.
Minors
Minors have 10 years from the date of malpractice to file a claim. However, in cases of cancer misdiagnosis or foreign objects, these other statutes apply.
Insanity
Medical malpractice cases involving those legally deemed insane must be filed within two years and six months of the date they are cured.
Wrongful Death
If medical malpractice contributed to wrongful death, the family of the decedent has two years from the date of the death to file a claim.
