Common Pediatric Malpractice Claims Child Medical Negligence Cases

There are numerous medical mistakes that affect the lives of children. Below are some examples of common medical malpractice cases, and why negligent pediatricians must be held liable.

Birth Injury

Injuries during child birth have a major effect on the growth and development of a child, and also impact the life of the child's mother. Cerebral palsy, Erb's palsy, infections after delivery, and failure to perform a C-section are unfortunately common forms of malpractice.

Misdiagnosis/Delayed Diagnosis

Medical conditions must be diagnosed when symptoms are present, and pediatricians must exercise greater diligence if a child is at risk of developing a health issue. Sadly, mistakes are made in testing and during exams. Misdiagnosing or failing to diagnose a problem can be disastrous, even fatal.

Appendicitis

Appendicitis is an infection of the appendix, an organ located on the lower right side of the abdomen. Symptoms start as a fever and stomach ache, eventually becoming more severe. Children with appendicitis must undergo emergency surgery to remove the appendix (appendectomy).

Medication Errors

Medication errors comprise a number of medical malpractice claims involving children. Examples include a pediatrician prescribing the wrong kind of medicine, a failure to note contraindications with other drugs a child is taking, and pharmacy errors regarding dosage or instructions.

Surgical Errors

When a surgeon makes a mistake, the consequences are life-altering. That's especially true when the patient is a child or infant. Surgical errors at an early age can result in disfigurement and disabilities. Even years of corrective or reconstructive treatments may not undo the harm.

Effects on the Life of Your Child The Consequences of Pediatric Medical Malpractice

Pediatric medical malpractice can affect the entire household. Children who survive their ordeal could face numerous challenges as they grow up. These are some of the lingering effects of pediatric medical malpractice, and why seeking damages is crucial given the potential difficulties ahead.

Long-Term Medical Problems

A surgical mistake or a debilitating illness that was misdiagnosed may require additional medical treatment for several years. Sometimes injured children will need medical care well into adulthood.

Additional Medical Expenses

More medical procedures means additional expenses for a household. For children who require lifelong medical care due to a pediatrician's mistakes, they'll have to shoulder these expenses throughout their adult life.

Developmental Setbacks

Oxygen deprivation during childbirth and other health problems at a crucial early age could lead to various physiological and psychological impairments. These can impact coordination, speech, and cognitive abilities.

Lower Quality of Life

Many children who survive instances of pediatric malpractice go on to lead fulfilling lives, yet their quality of life may not be the same as that of others. Lasting hardships are why it's important to seek legal compensation.

Aspects of Pediatric Malpractice Breaking Down Medical Negligence Claims

In all medical malpractice cases, certain facts need to be proved. First, your lawyer must demonstrate that there was a doctor-patient relationship between the pediatrician and your child. Second, that there was negligence. Third, this negligence led to injury or death that resulted in damages. Let's examine these key components of a medical malpractice case individually.

A Doctor-Patient Relationship

A doctor-patient relationship simply means that the patient (or in the case of a child, the minor's parent or guardian) sought medical help from a pediatrician, and the doctor knowingly accepted the child as a patient. Scheduled appointments and any administered medical treatments help establish this relationship.

Pediatrician's Negligence

When proving negligence, it's important to note the "standard of care." The term refers to the type of medical treatment that a competent pediatrician would have provided in the same situation. This covers diagnostic testing to invasive medical treatments. Failure to meet the standard of care is considered negligence.

Harm Resulting from Negligence

For a strong medical malpractice claim, the attorney must show a causal connection between the pediatrician's negligent actions and harm to the child. This harm may involve the need for additional medical procedures or the loss of a child's life. The losses and hardships linked to negligence are damages.

Damages and Settlements in Pediatric Medical Malpractice Claims

Different kinds of compensation can be sought in medical malpractice cases and wrongful death claims. Our New York attorneys can help seek fair compensation for your case, pushing back against medical facilities and insurance companies when they attempt to minimize your claim.

Pre-Trial Settlements

The majority of medical malpractice claims are settled before going to trial. Our lawyers will negotiate a fair settlement that takes your family's hardships and your child's future into account.

Compensatory Damages

Compensatory damages in a medical malpractice claim cover financial losses related to the pediatrician's errors, including medical bills, emotional pain and suffering, and, if necessary, funerary costs.

Punitive Damages

Punitive damages are not always awarded in medical malpractice claims except in egregious cases of negligence. These damages punish the negligent pediatrician, medical professional, or facility.
