However, the money received from a lawsuit or settlement is typically only enough to cover costs for a particular incident. Oftentimes, we have clients who are receiving benefits for disabilities that they have and they typically will be entitled to receive Medicaid or SSI or some type of benefit that they might become ineligible to receive because of the award they received in the lawsuit that we brought in that client's behalf. The law allows for the creation of special needs trusts for these clients where the settlement money or the money we recover in the lawsuit is placed into a trust. It allows the clients to continue to receive the benefits that they would otherwise be ineligible for as a result of the money they recovered in the lawsuit.
We have specialists who deal in the creation of these trusts to make sure the client's money is fully protected and that they continue to receive the benefits they need and that they were receiving before the lawsuit and still enjoy the proceeds of the settlement that we obtained on the client's behalf.
